Zasady współpracy i regulamin sprzedaży



We are grateful that you have chosen our offer. We would like to present you terms of payment and delivery which are in force by cooperation with our company. Please feel free to contact us for further questions you might have.

The following regulations are valid for deliveries from GFC Group LTD. (in the following called ASG).


Sales of air soft guns:

It is the sole responsibility of the buyer to sell air-soft guns in accordance with applicable national or EU legislation on the markets where the articles are sold by the buyer. It is also the responsibility of  the buyer to bring the importance of using safety eyeglasses, full masks or other similar safety equipment by using air soft guns to the customer’s  attention. In case the buyer does not comply with this provision any claim, loss and damage paid by ASG to the customer or others due to the non-compliance with the provision, must be reimbursed by the buyer to ASG.

 

Orders:

The minimal price of initial order amount to PLN 1000 net. There is no minimal price specified for next orders.

Waiting for payment for the order shall be a maximum of 8 calendar days. After that period, the order will be canceled and the client will be charged a fee of 50 EUR net.

Ordered articles that cannot be delivered, will be put into our system back with awaiting delivery status and they will be delivered with following orders. The price of undelivered product can be also subtracted from the price of next order.


Prices:

For all companies registered in Poland all prices mentioned in price lists, offers etc are in PLN including VAT without freight costs. For other companies from EU with European Tax ID Numbers all prices are in EURO excluding VAT and freight costs. Discount system is include in enclosure 1 and it is constantly changing. Buyer who is behind with payments lose his rights to any discount.


Terms of Payment:

All orders are realized after payments or they are sent with a bill which has to be paid by order receipt.

Local clients can received payment term after verification preceded with minimal turnover with ASG company in amount PLN 25000 gross In the case of client who’s turnover amount less then PLN 15000 gross pro year there is a possibility of losing the payment term receiving ability. Turnovers higher than PLN 25000 are not a guarantee of the payment term receiving. The final decision belongs to the ASG company.

The client can obtain a credit for a certain sum of money, which will be fixed on the basis of the cooperation so far with the possibility of an increase. Exceeding the beforehand fixed sum of the credit will result in the obligation to pay off all of the amount due or in the possibility of receiving ordered goods only after down payment or by paying the charges upon delivery.


Freight:

Freight costs are calculated in accordance with valid rates stated by forwarding agents used by ASG and they are claimed as a separate calculation entry on the invoice. The buyer is free to organise the delivery with own transport contacts.

If the goods are damaged during transport you must :

1)      Get a signature on the transport documents from the driver who confirms which damages have been made.

2)      Furthermore you must take a photo of the pallet/carton before checking the goods.

If you have not done as described above we cannot cover the loss you may have which means that buyer will lose his rights to any complaints.


Right to return of deliveries and complaints regarding the receipt of orders:

 

Delivered articles can be returned to ASG company, provided ASG in writing, per fax or by way of e-mail confirms the acceptance hereof. Any such returned article must still be in original packaging and unopened. Any returned article shall be forwarded to ASG within 14 days after the date of invoice. Returned articles are credited towards the customer with the purchase price of the article Articles to be returned cannot be given to sales representatives visiting a company.

 

Articles especially ordered by ASG for a customer are excluded from the right of return.

Complaint for lack of goods in the shipment must be filed within 5 calendar days from the date of receipt of goods ordered.
The complaint must be lodged by sending description of the problem to sales representative e-mail, adding the image specifications.

In the case of different goods in the package, a picture with the product packaging.

ASG Company reserves the right to choose how to resolve the complaint.
ASG company has 14 working days for a response to the complaint.


Guarantee:

All delivered articles from ASG are prepared to distribution. Products which gross price is higher than 200 PLN are sealed by ASG company.
In case a delivered article is faulty, ASG will replaces or repairs without charges. It is the decision of ASG if faulty articles are to be replaced or repaired. This guarantee only applies to new articles purchased from ASG.
New articles with errors caused by user handling, are excluded from the right of replacement.
As examples of errors caused by wrong user handling, the following can be mentioned:
 
    * Breakage of guns and/or additional equipment due to misuse
    * Attempts of home-made repairs or taken apart
    * Use pellets, which are used, or use of other pellets than those especially designed for air soft guns.
    * The magazine was not inserted or removed correctly.

Spare parts and wearing parts such as springs or seals are excluded from guarantee.
Guarantee rights are excluded in case of non-authorized repairs or where the air soft gun is opened / taken apart by users.

Articles for repair shall be sent to the ASG service department in Wrocław, Poland together with a filled-in RMA form which is available on www.airsofthurt.pl/rma (one form for each article) describing the fault. ASG preserves the right to acknowledge whether a repair is within the frame of guarantee rights.

The costs of shipping the repaired articles have to be covered by buyer.

Products which had been checked at customer’s request are excluded from the right of replacement.

 
Reservations:

ASG reserves the following rights:

    * Change prices without further notice
    * Cancel delivery of articles out of stock
    * Printing errors in price lists, catalogues etc.
    * Delay in delivery is the forwarding agent’s responsibility
      or it is a consequence of necessity of import ordered articles from additional magazines.

Until the buyer has made a complete and accurate payment, the sold articles remain the property of ASG.

The purchase of articles shall be governed by and construed in accordance with the laws of Poland.

The courts of Poland shall settle all disputes arising in connection with the purchase.

Placing an order in ASG company means that you accept the terms mentioned above.
